MARION COUNTY, Ind. -- Local attorney Nicholas Rowley, prevailed in a groundbreaking legal battle which unfolded in an Indiana state court. A Marion County, Indiana jury returned a verdict of $60.8 million in favor of a motorcyclist whom Rowley represented. Chris Dugan, the plaintiff, sustained a severe traumatic brain injury in a collision involving a Tesla employee's truck. The verdict, announced on Wednesday, marks a significant victory for both plaintiff Chris Dugan, and Decorah Attorney Nicholas Rowley, who represented Dugan in his pursuit of justice against the automotive giant. The trial shed light on the circumstances surrounding the accident, which occurred when Tesla technician Kyle Kaszuba made a left turn, colliding with Dugan's motorcycle. Rowley accused Kaszuba of making a reckless "blind turn," leading to Dugan's devastating injuries. Throughout the trial, Tesla vehemently denied liability, arguing that Dugan's driving behavior contributed to the collision. However, the jury ultimately sided with Dugan, holding Tesla accountable for the life-altering injuries he sustained. The jury found Kaszuba responsible for 70 percent of the accident, while Dugan was assigned 30 percent liability with his lack of a helmet and acceleration prior to the crash being complicating factors. "That was a tough fact to deal with," Rowley said. "I had to show that period of time was a half-a-second of invisibility out of eight other seconds where Chris Dugan was visible." Despite the reduction in the collectible award to $42.48 million, the outcome represents a substantial win for Dugan and his legal team. Rowley emphasized the significance of the verdict, highlighting Tesla's refusal to settle the case despite several offers. He also attributed Tesla CEO Elon Musk's stringent settlement policies as a contributing factor to the prolonged legal battle. Rowley expressed hope that the verdict would prompt Tesla to reconsider its approach to similar cases, advocating for accountability and justice for injured individuals.
