Disability Rights Iowa responds to new Supreme Court Memo

DES MOINES — Disability Rights Iowa is reassuring Iowans with disabilities that their legal right to receive services in community-based settings remains unchanged following new guidance from the U.S. Department of Justice. The advocacy organization issued a statement after the Justice Department released an internal memorandum June 18 addressing the U.S. Supreme Court's 1999 decision in Olmstead v. L.C., a disability rights case that established protections against unnecessary institutionalization. According to Disability Rights Iowa, the memo changes how the Justice Department will approach enforcement but does not alter existing law or the rights of people with disabilities. "Individuals with disabilities have the same rights of inclusion today as they did yesterday," the organization said. The Olmstead decision held that unjustified institutionalization of people with disabilities can constitute discrimination under the Americans with Disabilities Act. The ruling has since served as the legal foundation for requiring public entities to provide services in the most appropriate setting for a person's needs, often through home- and community-based services rather than institutional care. The Justice Department's memorandum reflects a different interpretation of the scope of that decision. It argues that Olmstead has been read too broadly over the past 25 years and that the Supreme Court did not establish a blanket requirement favoring community-based services over institutional settings in all cases. The memo also contends that federal regulations extend beyond what Congress authorized under the Americans with Disabilities Act and the Rehabilitation Act. Supporters of the revised interpretation say the change gives states greater flexibility in determining appropriate care settings and aligns federal enforcement more closely with the Supreme Court's original ruling. Disability rights advocates, however, warn that reducing federal enforcement could make it more difficult for people with disabilities to challenge unnecessary institutionalization and could weaken access to community living options. Disability Rights Iowa emphasized that the memorandum is an internal agency policy and does not change the law. "It does not change your right to inclusion under the Americans with Disabilities Act or the Rehabilitation Act," the organization said. "It does not change how DRI operates. It only changes how the DOJ operates." The organization said it will continue assisting Iowans who are living in institutions or who are at risk of unnecessary institutionalization and wish to live in their communities. Disability Rights Iowa also marked the anniversary of the Olmstead decision by honoring plaintiffs Lois Curtis and Elaine Wilson, whose lawsuit against the state of Georgia resulted in the landmark ruling. Curtis successfully argued she had the right to live in the community rather than remain institutionalized, setting a precedent that has shaped disability rights nationwide for more than two decades. The organization encouraged Iowans concerned about community integration protections to contact their members of Congress.
